Terms of Service

These terms govern use of the Synethy messaging service. By opening an account or sending traffic through us, you agree to them.

1. The service
We deliver SMS messages you submit to us onward to mobile networks. Message delivery depends on operators, handsets and regulators outside our control, so we cannot guarantee that any individual message is delivered or delivered within a particular time.
2. Your account
You are responsible for keeping your credentials secure and for all traffic sent using them. Tell us immediately at abuse@synethy.com if you believe your account has been compromised.
3. Acceptable use
You must have a lawful basis and, where required, valid consent for every recipient you message. You must honour opt-out requests promptly and include opt-out instructions where the law requires them. You must comply with the rules of each destination country, including sender ID registration and quiet-hours restrictions.
You must not use the service to send:
- unsolicited messages to recipients who have not agreed to receive them, where their agreement is legally required;
- content that is fraudulent, deceptive, or designed to obtain credentials, payment details or personal data under false pretences;
- content that is unlawful, harassing, defamatory, or infringes someone's rights;
- traffic that misrepresents its origin, or that is routed to evade operator filtering, charges or regulation.
We may suspend or terminate an account that breaches this section, without notice where the breach is serious or ongoing.
4. Pricing and payment
Rates are quoted per message segment per destination and are payable in advance from account credit unless we have agreed otherwise in writing. Rates may change with reasonable notice, since they depend on operator pricing. Credit is consumed as messages are submitted; a message accepted by an operator is chargeable even if the handset never receives it.
5. Suspension
We may suspend the service where there is a security risk, a legal requirement, non-payment, or a breach of section 3. We will restore service as soon as the cause is resolved.
6. Liability
We provide the service with reasonable skill and care. To the extent the law allows, we are not liable for indirect or consequential loss, loss of profit, or loss of business, and our total liability in any twelve-month period is limited to the amount you paid us in that period. Nothing here limits liability that cannot lawfully be limited.
7. Data protection
Each party will comply with applicable data protection law. Where we process personal data on your behalf in delivering messages, we do so on your instructions. See our Privacy Policy.
8. Termination
Either party may end the agreement on written notice. Unused prepaid credit is refundable at our discretion, less any amounts owed.
9. Changes to these terms
We may update these terms. Material changes will be notified to account holders, and the date at the top of this page will change.
10. Governing law
These terms are governed by the law of [jurisdiction to be completed], and its courts have exclusive jurisdiction.
